Terms of Service

1. Acceptance of Terms

By accessing or using Selectic Inc.'s services ("Services"), including our mortgage concierge offering and the car and real estate agent waitlists, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Selectic provides the following services:

  • Mortgage Agent: An AI-assisted concierge that gathers lender quotes, organizes documents, negotiates fees, and tracks closing tasks on your behalf
  • Car Buying Agent (Waitlist): A forthcoming service that monitors inventory, requests quotes, and negotiates with dealerships when invited customers opt in
  • Real Estate Agent (Waitlist): A forthcoming service that coordinates showings, analyzes comps, and negotiates with listing agents for invited customers

Our Services are designed to support your negotiations and financial decisions but do not constitute legal, tax, or financial advisory services. Final decisions are your responsibility.

3. User Accounts

To use our Services, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and current information

You must be at least 18 years old to use our Services.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

  • Provide false, inaccurate, or misleading information
  • Use the Services to engage in fraudulent activities
  • Generate or act on illegal, harmful, or deceptive scenarios
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Use the Services to violate any laws or regulations

5. Mortgage Services Specific Terms

5.1 Scope of Work

Our mortgage agent contacts lenders, gathers quotes, organizes documentation, negotiates rate and fee concessions, and keeps you updated on milestone status. We do not provide legal, tax, or investment advice.

5.2 Service Tiers

Mortgage services are offered as fixed-fee packages:

  • Market Recon: $300 one-time fee covering up to 10 lender quotes and a written comparison
  • Rate Hunter: $400 one-time fee covering full-market outreach (up to 30 quotes) and negotiation support
  • Deal Closer: $800 one-time fee covering negotiation, credit tracking, and closing coordination

Fees are due when you authorize the engagement. Refunds are not provided once outreach has begun.

5.3 Not a Lender

Selectic is not a lender, loan broker, or mortgage banker. We introduce you to lenders, negotiate on your behalf, and relay information, but final lending decisions rest entirely with the lenders you choose.

6. Fees and Payment

Certain Services require payment of fees:

  • Mortgage Agent: Fixed-fee packages listed above
  • Car & Real Estate Agents: Pricing will be provided before any work begins for invited customers

All fees are non-refundable once work has started unless otherwise stated in writing. We reserve the right to change our fees with notice.

7. Intellectual Property

The Services and their original content, features, and functionality—including outreach playbooks, workflows, negotiation tools, data collection scripts, and comparison dashboards—are and will remain the exclusive property of Selectic Inc. and its licensors.

You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

8. User Content and Data

You retain ownership of any content, data, or information you provide to our Services ("User Content"). By using our Services, you grant us a license to use your User Content solely to provide Services to you.

For mortgage services, your data is shared only with lenders you explicitly choose. We never sell your User Content to third parties.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of results

Selectic does not guarantee specific outcomes, mortgage approvals, or rate savings.

10. Limitation of Liability

To the fullest extent permitted by law, Selectic Inc. shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from your use of or inability to use the Services
  • Damages resulting from reliance on analyses, comparisons, or quotes we share

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Selectic Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at v@selectic.ai.

Upon termination, your right to use the Services will cease immediately. Provisions that should survive termination (including warranty disclaimers, limitations of liability, and dispute resolution) will remain in effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on our website. Your continued use of the Services after changes constitute acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Selectic Inc. regarding the Services and supersede all prior agreements.
