Terms of Service

1. Acceptance of Terms

By accessing or using Selectic's services ("Services"), including our AI car negotiation platform, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Selectic provides the following services:

  • Car Inventory Search: Search and browse available vehicles from dealerships
  • AI Negotiation: Our AI agents contact dealers via email and SMS on your behalf to negotiate prices
  • Quote Comparison: Side-by-side comparison of dealer offers and pricing
  • Privacy Protection: Your personal contact information stays private until you accept an offer

Our Services are designed to assist with car purchasing negotiations but do not constitute legal, tax, or financial advisory services. Final decisions are your responsibility.

3. User Accounts

To use our Services, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and current information

You must be at least 18 years old to use our Services.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

  • Provide false, inaccurate, or misleading information
  • Use the Services to engage in fraudulent activities
  • Harass or abuse dealers through our platform
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Use the Services to violate any laws or regulations

5. Subscription Plans

5.1 Pricing

Selectic offers the following subscription plans:

  • Monthly: $50/month for up to 50 negotiations per month
  • One-Time: $100 fixed fee for up to 100 negotiations total

Fees are due at the time of purchase. Monthly subscriptions renew automatically unless cancelled.

5.2 Cancellation

Monthly subscriptions can be cancelled at any time. Upon cancellation, your subscription will remain active until the end of the current billing period.

6. AI Negotiation Services

6.1 Privacy Until Acceptance

Your personal contact information (name, email, phone) is not shared with dealers until you accept an offer. All communications with dealers are conducted through Selectic's dedicated email addresses and phone numbers.

6.2 No Guarantee of Results

While we strive to get you the best possible price, Selectic does not guarantee specific savings, prices, or outcomes. Dealers may not respond or may decline to negotiate.

7. SMS Communications

If you opt in to SMS notifications by providing your mobile phone number:

  • You will receive account and service notifications via SMS, including updates about your negotiations, dealer responses, and important account alerts
  • Your mobile phone number will not be sold, shared, or disclosed to third parties or affiliates for promotional or marketing purposes
  • Message frequency varies based on your account activity
  • Standard message and data rates may apply
  • You may opt out at any time by replying STOP to any message or updating your preferences in your account settings
  • Reply HELP for assistance

Consent to receive SMS is not a condition of purchase. You can use our services without opting in to SMS notifications.

8. Intellectual Property

The Services and their original content, features, and functionality—including AI negotiation algorithms, comparison tools, and user interfaces—are and will remain the exclusive property of Selectic and its licensors.

You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

9. User Content and Data

You retain ownership of any content, data, or information you provide to our Services ("User Content"). By using our Services, you grant us a license to use your User Content solely to provide Services to you.

Your data is shared with dealers only when you explicitly accept an offer. We never sell your User Content to third parties.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of results

Selectic does not guarantee specific outcomes, price reductions, or dealer responses.

11. Limitation of Liability

To the fullest extent permitted by law, Selectic shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from your use of or inability to use the Services
  • Damages resulting from reliance on quotes or negotiations we facilitate

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Selectic, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party

13. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at team@selectic.ai.

Upon termination, your right to use the Services will cease immediately. Provisions that should survive termination (including warranty disclaimers, limitations of liability, and dispute resolution) will remain in effect.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on our website. Your continued use of the Services after changes constitute acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Selectic regarding the Services and supersede all prior agreements.
